We also have this same problem and branch back to the findnextfile. The seond time through will correctly pick up the file name. Attached is the code we use to check this. Most of our users are on CAW and use their local folder 'C:\Scan\' to either scan or copy a file into it. The program then verifies a file exists before letting the user continue.
