seems that there are two backups (on saves and on version saves... every 10 minutes)
when specifying a special name format such as
filename(####)extension
this conflicts if .BAK is specified also (either where it's appended to the file.ext or where it replaces the .ext)
had to take off the backup on save options (both of them above) and now it seems to work OK
