It doesnt hurt to talk to either. My wife owns a business, and we had a similar problem with a client that refused to pay, and she did not have a contract either. Try talking to a collection agency and see where you get. You might be able to recoup some of your money.
I know a signed contract with some companies might seem daunting. Consider asking new clients who's work is going to exceed a certain dollar amount for a signed purchase order. That may work in lieu of a contract in many cases. I'm not an attorney, so again it may not hurt to talk to one and get some good advice. Its too bad that there are customers like that out there.
